Text Box: Vancouver Photographer and entrepreneur Roy Kerwood has launched a legal action against Vancouver Based book distributor RAINCOAST Book Distribution, The Beatles through Apple Corps Ltd. Chronicle Books ltd and Indigo Books and Music.
Mr. Kerwood alleges in his action that the defendants violated the copyright act of Canada by using photographs taken by Mr. Kerwood at the ‘Bed In For Peace In Montreal In 1969, in the publication ‘The Beatle Anthology by The Beatles’ without his permission.
He goes on in documents filed in the B.C. Supreme Court that in 1969, when John Lennon was in Canada promoting peace at his now famous ‘Bed In For Peace” in Montreal that Mr. Kerwood, who was invited by John Lennon to take photos there, and subsequently gave John Lennon a set of photos to look at, with a view to selling the images to John Lennon, that John Lennon never paid for these images nor returned them to Mr. Kerwood as he was promised by Derek Taylor, John’s ‘right hand man’.
In 2002 Mr. Kerwood was showing his images at a special show at a restaurant the ‘The Red Onion’ in Vancouver he says that he met an avid Beatles fan Mr. Mike Cooke, owner of ‘Cross town Slo-Ptich’ who showed Mr. Kerwood the book .
Mr. Kerwood spent 11/2 years trying to get Apple Corps Ltd. to recognise the images as his property he has been forced to take the extraordinary action of suing them and the publishers distributors and resellers of the book.
Mr. Kerwood is seeking damages of over $1,000,000 and an injunction against sale or distribution of the book, this comes just weeks after Raincoast Book Distribution of Vancouver themselves got an injunction against readers of the new Harry Potter book due to a  an early sale of copies of the book.
